Welcome and thank you for visiting The Kimberly Wiseman Corporation (hereafter "TKWC") website. TKWC has a no tolerance spam policy. TKWC prohibits the use of the TKWC website and services in any manner associated with the transmission, distribution or delivery of any unsolicited bulk or unsolicited commercial e-mail, mass email, or junk email ("Spam"). Any affiliate or client found to be associated or using Spam will be immediately terminated from the use of the TKWC product and affiliate program and will be reported to the proper authorities. In addition, if you Spam, you will be subject to the loss of all TKWC services, and may forfeit all monies due, and/or be fined pursuant to laws governing Spam. You may also be subject to possible legal action. Failure to enforce this Anti-Spam Policy in every instance does not amount to a waiver of TKWC's rights.

In addition, e-mail sent, or caused to be sent to or through the TKWC Services may not: use or contain invalid or forged headers; use or contain invalid or non-existent domain names; employ any technique to otherwise misrepresent, hide or obscure any information in identifying the point of origin or the transmission path; or use other means of deceptive addressing; o use a third party's internet domain name, or be relayed from or through a third party's equipment, without permission of the third party; contain false or misleading information in the subject line or otherwise contain false or misleading content; otherwise fail to comply with other TKWC policies.

TKWC does not authorize the harvesting, mining or collection of e-mail addresses or other information from or through TKWC services. TKWC does not permit or authorize others to use any of TKWC services to collect, compile or obtain any information about its customers or subscribers, which are TKWC's confidential and proprietary information.

Nothing in this policy is intended to grant any right to transmit or send e-mail to, or through, the TKWC website or services.

What is Spam? Spam is unsolicited email also known as UCE (Unsolicited Commercial Email). By sending email only to those who have requested to receive it or with whom there is a preexisting business relationship, you are likely following accepted permission-based email guidelines.

What constitutes a preexisting business relationship? The recipient of your email has made a purchase, requested information, responded to a questionnaire or a survey, or had offline contact with you.

What constitutes consent? The recipient of your email has been clearly and fully notified of the collection and use of his or her email address and has consented prior to such collection and use. This is often called informed consent.

Isn't there a law against sending Spam? Yes. There are federal, state, and international laws governing Spam. The penalties can include fines and/or imprisonment. Our Anti-Spam Policy has been developed to conform to the highest commercially reasonable standards.

Reporting Spam: If you believe that you have received Spam from or through TKWC, please send a complaint from your email account along with the unsolicited email, with completed header to our submission contact page. Please provide any other information that you believe may help us in our investigation. TKWC does not investigate or take any action based on "anonymous" spam complaints. How to protect yourself from Spam: Take the Spam Test 1. Are you importing a purchased list of ANY kind? 2. Are you sending to non-specific addresses such as: sales@domain.com, business@domain.com, webmaster@domain.com, info@domain.com, or other general addresses. 3. Are you sending to distribution lists or mailing lists which send indirectly to a variety of email addresses? 4. Are you mailing to anyone who has not explicitly agreed to join your mailing list? 5. Have you falsified your originating address or transmission path information? 6. Have you used a third party email address or domain name without their permission? 7. Does your e-mail's subject line contain false or misleading information? 8. Does your email fail to provide a working link to unsubscribe?
